June 7, 2019 OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS NOTIFICATION OF SIGNIFICANT LICENSING ACTION LICENSEE: Exelon Generating Company, LLC Oyster Creek Nuclear Generating Station Docket No(s). 50-219 and 72-15

PROPOSED ISSUANCE OF AN ORDER APPROVING A LICENSE TRANSFER APPLICATION FOR WHICH A HEARING HAS BEEN REQUESTED (EPID L-2018-LLM-0002)

This is to inform the Commission that an order approving the direct transfer of Renewed Facility Operating License No. DPR-16 for the Oyster Creek Nuclear Generating Station (OCNGS), and its general license for the OCNGS Independent Spent Fuel Storage Installation, from Exelon Generating Company, LLC, to Oyster Creek Environmental Protection, LLC, as owner, and to Holtec Decommissioning International, LLC (HDI), as operator for decommissioning, will be issued on or about June 28, 2019. This action is being taken in response to the license transfer application dated August 31, 2018, as supplemented on September 28, 2018. The U.S. Nuclear Regulatory Commission (NRC) will also issue a regulatory exemption to HDI related to the use of funds from the OCNGS decommissioning trust fund for spent fuel management and site restoration activities simultaneously with the license transfer order. The NRC also plans to issue a conforming amendment for the facility operating license for administrative purposes to reflect the approved license transfer following consummation of the license transfer transaction.

A hearing on the license transfer application was requested by the New Jersey Sierra Club and the Town of Lacey Township on November 1, 2018 and November 8, 2018, respectively, and will not be completed prior to the issuance of the amendment.

The State of New Jersey was notified on May 16, 2019, that the NRC intends to issue the Order approving the transfer and the conforming amendment, and grant the exemption for the use of the decommissioning trust fund for spent fuel management and site restoration activities.
