ORDER APPROVING TRANSFER OF THE LICENSE FOR THE OYSTER CREEK NUCLEAR GENERATING STATION AND CONFORMING LICENSE AMENDMENT (EPID# L-2018-LLM-0002)

Dear Mr. Hanson:

By letter dated August 31, 2018 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML18243A489), including proprietary financial information provided as A 1, Asset Purchase and Sale Agreement, Exelon Generation Company, LLC (Exelon), Oyster Creek Environmental Protection, LLC (OCEP) and Holtec Decommissioning International, LLC (HDI) (together, applicants) requested that the U.S. Nuclear Regulatory Commission (NRC) consent to the proposed direct transfer of the Oyster Creek Nuclear Generating Station (Oyster Creek) Renewed Facility Operating License No. DPR-16 and the Oyster Creek Independent Spent Fuel Storage Installation general license from Exelon to OCEP as the licensed owner and to HDI as the licensed decommissioning operator. The direct transfer request is submitted to NRC for approval pursuant to Section 184 of the Atomic Energy Act of 1954, as amended, Inalienability of Licenses, and Title 10 of the Code of Federal Regulations (10 CFR) 50.80, Transfer of licenses, 10 CFR 72.50, Transfer of licenses, and 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit.

The applicants also requested that NRC approve a conforming administrative amendment to the license to reflect the proposed direct transfer.

Notice of NRC consideration of the application was published in the Federal Register (FR) on October 19, 2018 (83 FR 53119) and included an opportunity to comment, request a hearing, and petition for leave to intervene. The comment period was re-opened on December 10, 2018, (83 FR 63544) for an additional 30-days to allow time for members of the public to develop and submit comments.

The NRC staff completed its review of the Oyster Creek license transfer application. is the Order (ADAMS Accession No. ML19095A458), which provides consent to the direct license transfers, subject to the conditions described therein, and approves the conforming license amendment. A copy of the Order will be forwarded to the Office of the FR for publication.

B. Hanson Enclosure 2 provides the conforming amendment for Oyster Creek (ADAMS Accession No. ML19095A461), which will be signed and become effective at the time the transfers are enacted. Enclosure 3 provides the NRC staffs safety evaluation (ADAMS Accession No. ML19095A457) related to the approval of the transfer of a license issued by the NRC and an associated conforming amendment required to reflect the approval of the transfer that notes these actions meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(21). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the approval of the transfer application and conforming license amendment.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS. ADAMS is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html.
