REQUEST FOR ADDITIONAL INFORMATION SET 3 FOR THE INTEGRATED SAFETY ANALYSIS (PROGRAMMATIC} AND SECURITY REGARDING THE TRISO-X, LLC LICENSE APPLICATION FOR A NEW FUEL FABRICATION FACILITY (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2022-NEW-0005)

Dear Jennifer Wheeler:

The U. S. Nuclear Regulatory Commission (NRC) staff has developed the third set of requests for additional information (RAls) to support the integrated safety analysis (ISA)

(programmatic) and security review of the TRISO-X, LLC safety and safeguards license application. Your application for a new fuel fabrication facility located in Oak Ridge, TN was submitted via letter dated April 5, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML22101A200) and supplemented by letters dated October 13, 2022 (ML22286A144) and November 4, 2022 (ML22308A251).

The RAls provided in the enclosures to this letter are non-public because they contain security related information. Please consider providing your draft responses in advance of the formal response letter and holding a meeting to ensure mutual understanding of the responses. The draft response and alignment meeting should be held within 30 days of the date of this letter and the formal response provided within 45 days of the date of this letter.

We continue to anticipate completing our review by June 2025, as previously stated in our acceptance review dated November 18, 2022 (ML22320A110). Note that resolution of the programmatic ISA Summary RAls is critical for the NRC staff to be able to proceed with the more detailed technical review for multiple areas including ISA summary, structural, criticality, human factors, quality assurance/management measures, etc. (e.g., those review areas impacted by the ISA methodology). The proposed completion date could change depending on submittal of supplements to the application, the resolution of RAls, findings of our technical review, or other factors. We will promptly communicate any significant changes to this schedule.

In accordance with Title 1O of the Code of Federal Regulations, Section 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available The enclosures transmitted contain security related information. When separated from the enclosures, this letter is decontrolled.
