REQUEST FOR ADDITIONAL INFORMATION AS SET 13 FOR CHAPTERS 1 AND 2 OF THE LICENSE APPLICATION FOR THE TRISO-X, LLC FUEL FABRICATION FACILITY (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2022-NEW-0005)

Dear Jennifer Wheeler:

The U.S. Nuclear Regulatory Commission (NRC) staff has developed subsequent requests for additional information (RAIs) as set 13 to support the review of the TRISO-X, LLC safety and safeguards license application. Your application for a new fuel fabrication facility located in Oak Ridge, Tennessee was submitted via letter dated April 5, 2022 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML22101A200) and supplemented by letters dated October 13, 2022 (ML22286A144) and November 4, 2022 (ML22308A251) and revised license application submitted by letters dated December 30, 2024 (ML24365A254) and January 31, 2025 (ML25031A449).

Our review of your license application has identified the need for additional RAIs on Chapter 1 and 2 of the license application. The additional information requested in the public enclosure to this letter should be provided within 30 days from April 28, 2025, the date the draft RAI was emailed to you to confirm mutual understanding of issues. An alignment call to discuss the draft RAI was held on April 30, from 3:30-5:00pm. The TRISO-X staff provided several comments on the RAIs to improve readability. As a result of the call, the NRC staff was able to remove one of the RAIs in Chapter 1 because the information was identified in the fundamental nuclear material control plan and one RAI in Chapter 2 was simplified from three parts to a single issue based on clarification of the issue during the call. The clarifications identified during the call have been incorporated in the enclosure.

Please let us know if you have an interest in holding a call to discuss the draft responses prior to formal submittal, consistent with the NRC staff RAI process described in LIC-FM-3, section 2.10.1(b) (ML22208A272). Extending the formal responses beyond the 30 days, the need for supplements, or a second round of RAIs may result in an extension of the proposed review schedule beyond May 2026 (ML23305A193).

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and enclosure will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
