NUCLEAR REGULATORY COMMISSION OBSERVATION TO SUPPORT THE TRISO-X, LLC LICENSE APPLICATION FOR A FUEL FABRICATION FACILITY (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2022-NEW-0005)

Dear Jennifer Wheeler:

The U.S. Nuclear Regulatory Commission (NRC) staff has developed a number of observations regarding the TRISO-X license application. These observations were developed during the acceptance review completed on November 18, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22320A110). Although these observations did not need to be resolved prior to docketing, they will be considered during the review of the license application and to inform the development of requests for additional information. The observations are being provided to TRISO-X for awareness and to allow additional time to consider and discuss the issues with the NRC staff. There is no requirement for TRISO-X to provide a formal response until requests for additional information are issued.

A meeting has been scheduled with you for January 10, 2023, to discuss the observations in a part open and part closed public meeting. It will be noticed on the NRC public meeting website.

A public and non-public version of the observations are provided as enclosures.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section #2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs (ADAMS). ADAMS is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html.
