NRC Contract No. NRC-17-83-399 This confirms the telecon of May 26, 1983 between yourself and Teresa McLearen.

NRC. The subject contract provides that daily copies of transcripts be delivered to the hearing site and MRC Headquarters by 8:15 a.m., the next business day following a hearing. However, since many of the hearings are held outside the Washington Metropolitan area, the contract allows additional time for delivery to Headquarters (Article VI, Paragraph Ig).

During our meeting on May 2,1983, you requested an increase in the additional time allowance provided in the contract to make NRC Headquarters delivery of transcripts of hearings held outside the Washington Metropolitan area. Spe-cifically, you stated that the one-day delivery allouance for hearings held in '

New York was not reasonable and that you could not make NRC Headquarters delivery by 8:15 a.m. the second day after a hearing unless extraordinary delivery methods  !

vere utilized. 1 In a second meeting on this subject on May 12, 1983, with members of the NRC Program Office in attendance, you reiterated your request for relief from the one-day delivery allowance for areas specified in Article VI, Paragraph 1g.

I stated in both of these meetings, that the delivery allowance was clearly I spelled out in the solicitation and that Tayloe Associates had never raised an objection to it, although many other changes had been requested. Also, the delivery schedule may have been a factor preventing other reporting services - i from responding to our Request for Proposals.

I have held discussions with the Program Offices concerning their requirements.

The NRC has determined that its original delivery requirements remain firm.

Your request for an increase in the additional time allowance provided in the contract is denied.
