As a result of the June 27, 1983 telecon between your attorney, Joseph l

Gallo and Teresa McLearen, NRC Contract Administrator, the subject I

modification which provides for the acquisition of 9-track magnetic I tapes of the Indian Point proceeding has been revised to include the date of that proceeding. This modification also adds the Bowers Reporting Company to the list of approved subcontractors as requested by your June 23, 1983 letter and deletes paragraphs four and seven'which address transcript covers and the price per page for _ late delivery of transcripts' taken during non-regular hours, respectively. If you agree with the provisions of this document please execute three copies and return them to me. The fourth copy is for your files. Upon receipt of the three signed copies. I will execute them on behalf of the Commission and one fully executed copy will be returned to you.

1 While we have agreed to remove paragraphs four and seven from this i modification, I am extremely perplexea by the contradictory positions assumed by you and Mr. Gallo concerning these paragraphs. Despite the fact that Ms. McLearen had negotiated "in good faith" and reached an

_ agreement with you concerning the provisions of paragraphs four and seven and had incorporated those terms in the initial. modification transmitted to you on May 23, 1983 Mr. Gallo has now advised Ms. McLearen that Tayloe Associates is not prepared to agree to these same terms. I am sure ,

, you will agree that this type of inconsistency must be resolved immediately

- in order to preclude any potential misunderstandings concerning future negotiations. Correspondence currently on file at NRC indicates that Mr. Tayloe is the only individual authorized to negotiate and execute contracts on behalf of Tayloe Associates. Accordingly, future negotiations with respect to this contract will be conducted with Mr. Tayloe, directly.

. In .the event Mr. Tayloe wishes.to identify other individuals as authorized to negotiate on behalf of Tayloe Associates, it is requested those individuals' names be submitted to NRC in writing. ' '
