FRAMATOME TECHNOLGIES. INC.

Dear Mr. Taylor:

By letter dated June 9, 1997. Union Electric Company (UE) submitted a 3roprietary copy of slides that were presented at the May 6, 1997, and iay 13-14.1997. meetings between the NRC. Union Electric Com)any and Framatome Technologies. Inc.. and requested that they be withield from public disclosure )ursuant to 10 CFR 2.790. A non-proprietary version of the slides was also suamitted for placement in the public document room.

An affidavit dated May 29. 1997. from Framatome Technologies. Inc., the owner of the slides, was included in the letter. Framatome Technologies. Inc.

states that the submitted information should be considered exempt from mandatory public disclosure for the following reasons.

"(ii) b. The information reveals data or material concerning FTl research or development plans or programs of present or potential competitive advantage to Fil.

c. The use of the information by a competitor would decrease his expenditures. in time or resources in designing, producing or

'g Mr. James H. Taylor Therefore, we have determined that the slides provided in the_ June 9. 1997, letter from Union Electric marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made-available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. -in all review situations.1f the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
