SUMMARY

OF APRIL 6 AND 7, 2020, COVID-19 RELATED PRESUBMITTAL TELECONFERENCES WITH VISTRA OPERATIONS COMPANY LLC TO DISCUSS LICENSING ACTIONS SUPPORTING THE COMANCHE PEAK NUCLEAR POWER PLANT, UNIT NO. 2 SPRING 2020 REFUELING OUTAGE (EPID L-2020-LRM-0028)

On April 6 and 7, 2020, Category 1 public teleconferences were held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Vistra Operations Company LLC (the licensee). Due to the COVID-19 pandemic, the licensee proposed to delay inspections and testing for one refueling cycle from the Comanche Peak Nuclear Power Plant, Unit No. 2 (Comanche Peak Unit 2) spring 2020 refueling outage (2RF18) to the fall 2021 refueling outage (2RF19). These deferrals are to minimize the potential of inadvertently spreading the COVID-19 virus to licensee personnel and the local community from outside contractors who perform inspections and testing. The purpose of the April 6, 2020, teleconference was to discuss a proposed exigent license amendment request (LAR) to defer steam generator inspections. The purpose of the April 7, 2020, teleconference was to discuss proposed requests to delay various inspections and testing required by the American Society of Mechanical Engineers Boiler and Pressure Vessel Code, and Code for Operation and Maintenance of Nuclear Power Plant, in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 50.55a(z)(2), in support of the Comanche Peak Unit 2 spring 2020 refueling outage. The meeting notices and agendas were both issued on April 2, 2020 (References 1 and 2). A list of attendees for the April 6 and 7, 2020, teleconferences are in Enclosures 1 and 2, respectively. The references are listed in Enclosure 3.

For the April 6, 2020, teleconference, the licensee presented informational slides (Reference 3) regarding the proposed LAR to revise Technical Specification 5.5.9, Unit 1 Model D76 and Unit 2 Model D5 Steam Generator (SG) Program, to effect the deferral of the Comanche Peak Unit 2 steam generator inspections. Topics discussed included the following:

1. Reason for Proposed Amendment
2. Description of Current Steam Generator Program Technical Specifications and Proposed Changes
3. Comanche Peak Unit-2 Steam Generator Information
4. Technical Information to be Provided with the LAR
5. LAR Schedule

The NRC staff and the licensee discussed the above topics and NRC staff provided feedback on information needed for a complete application. Several members of the public called into the teleconference but had no comments. No regulatory decisions or commitments were made at the meeting. Additionally, the NRC staff did not receive Public Meeting Feedback forms.

For the April 7, 2020, teleconference, the NRC staff and the license discussed the licensees discussion topics (Reference 4), which consisted of the following six proposed requests.

1. Inservice Inspection
2. Reactor Vessel Nozzle Dissimilar Metal Welds Ultrasonic Inspection
3. Bottom Mounted Instrumentation (BMI) Visual Inspection
4. Reactor Head Penetration Visual Inspection
5. Snubbers
6. Inservice Testing The licensee generically described the basis for hardship without a compensating increase in the level of quality and safety in accordance with 10 CFR 50.55a(z)(2) for those examinations and testing it proposed to defer. The NRC staff asked about the basis for various visual examinations proposed to be deferred. The licensee explained that it had limited qualified staff that could perform these examinations, as the licensee typically uses specially qualified contractors to perform the examinations. The licensee discussed for each proposed request the applicable code, the applicable components, the information planned to be submitted, the proposed submittal date, and the proposed request date. The NRC staff provided feedback on information needed for complete requests. Several members of the public called into the teleconference and there was one comment related to the impact of the deferred examinations and testing on the length of the refueling outage. No regulatory decisions or commitments were made at the meeting. Additionally, the NRC staff did not receive Public Meeting Feedback forms.
