SUMMARY

OF APRIL 7, 2021, PRESUBMITTAL MEETING WITH VISTRA OPERATIONS COMPANY LLC REGARDING THE PROPOSED EXEMPTION REQUEST TO DEFER THE ANNUAL FORCE-ON-FORCE EXERCISE FOR COMANCHE PEAK NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2 (EPID L-2021-LRM-0039)

On April 7, 2021, an Observation public presubmittal meeting, conducted as a webinar, was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Vistra Operations Company LLC (the licensee). The purpose of the meeting was to discuss a proposed COVID-19 related exemption request to allow the deferment of the completion of the calendar year 2021 annual force-on-force exercise from June 15 to September 30, 2021, for the Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2 (Comanche Peak). The meeting notice and agenda, dated March 25, 2021, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML21084A479. A list of attendees is enclosed.

The licensee presented informational slides at the meeting, which can be found in ADAMS at Accession No. ML21095A305. The NRC staff also prepared talking points for the meeting, which can be found in ADAMS at Accession No. ML21097A052. In its talking points, the NRC identified preliminary feedback on eight topics for consideration in a potential exemption request from the annual force-on-force (FOF) requirements for the period beyond that covered by to the NRCs guidance letter, U.S. Nuclear Regulatory Commission Updated Planned Actions Related to Certain Requirements for Operating and Decommissioning Reactor Licensees During the Coronavirus Disease 2019 Public Health Emergency, dated November 10, 2020 (ADAMS Accession No. ML20261H515). The NRC staff developed the preliminary feedback based on existing guidance, the licensees presentation, information provided through normal informal project manager interactions, and other generally available information and was specific to the proposed Comanche Peak exemption request. This preliminary feedback was intended for discussion purposes only and did not constitute a final regulatory position. The NRC talking points also included background information to support discussions. The NRC staff and the licensee discussed each of the NRC staff talking points, and the licensee indicated that it would consider them in the preparation of its exemption request.

The licensee representatives stated they were planning on implementing NRC Inspection Procedure (IP) 92707, Security Inspection of Facilities Impacted by a Local, State, or Federal Emergency Where the NRCs Ability to Conduct Triennial Force On-Force Exercises is

Limited,1 type of exercise for annual FOF exercises. The NRC staff clarified that a IP 92707 FOF exercise is a limited scope exercise and only evaluates key elements of the site strategy.

It does not represent an overall assessment related to the effectiveness of the sites strategy.

Furthermore, the NRC staff further clarified that only the minimum amount of artificialities and simulations should be used as a result of COVID-19.

One member of the public attended the meeting and had no comments. No public meeting feedback forms were received. No regulatory decisions were made at the meeting.
