SUMMARY

OF APRIL 6, 2021, MEETING WITH VISTRA OPERATIONS COMPANY LLC TO DEFER THE BIENNIAL EMERGENCY PLANNING EXERCISE FOR COMANCHE PEAK NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2 (EPID L-2021-LRM-0035)

On April 6, 2021, an Observation public meeting, conducted as a webinar, was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Vistra Operations Company LLC (the licensee). The purpose of the meeting was to discuss a proposed COVID-19 related exemption request to defer the biennial emergency planning (EP) exercise from Calendar Year 2021 to 2022 for Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2.

The meeting notice and agenda, dated March 25, 2021, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML21084A476. A list of attendees is enclosed.

The licensee presented informational slides at the meeting, which can be found in ADAMS at Accession No. ML21092A030. During the meeting, the licensee discussed the basis for the proposed exemption request, efforts to reschedule the EP exercise to later in 2021, activities to exercise emergency response strategies, and proposed 2022 biennial EP exercise plans. The licensee also indicated that future biennial EP exercises will be conducted in odd years. The licensee indicated it plans to submit the exemption request in April 2021. The licensee and the NRC staff discussed each of these topics. The NRC staff suggested that the licensee should also consider the guidance in the NRC letter dated November 10, 2021 (ADAMS Accession No. ML20261H515) in addition to the guidance listed as references in the licensees presentation. The NRC staff noted that there are differences in the guidelines for requesting exemptions from the onsite biennial exercise requirement (Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Appendix E,Section IV.F.2.b) compared to the offsite biennal exercise requirement (10 CFR Part 50, Appendix E, Section IV.F.2.c). The NRC staff further noted that since the biennial exercise requirements are calendar year requirements, an exemption is needed in the calendar year rather than before the deferred planned exercise.

The licensee indicated that it would consider the topics discussed in preparing its exemption request.

No members of the public attended the meeting. No public meeting feedback forms were received. No regulatory decisions were made at the meeting.
