Dear Members of the Appeal Board:

In the Matter of PACIFIC GAS AND ELECTRIC COMPANY (Diablo Canyon Nuclear _ Power Plant,~ Units 1 and 2)

Docket-Nos. 50-275 OL and 50-323 OL'

_.On April 10, 1984, the Board requested the parties to inform it whether-FEMA has issued " findings on the adequacy-of the state emergency response

' plan."' This request was made in order to' determine whether the appeals

by PGandE and the staff of the Licensing Board's condition "that the
director of nuclear reactor regulation must secure FEMA findings on

! the adequacy of the state emergency _ response plan" prior to issuance of t

a full power license were moot. PGandE's-response to this request follows.

During the ful-1 power hearings conducted in January, 1982, the March, 1981,. State of California Nuclear Power Plant Emergency _ Response Plan was' introduced as-evidence. Mr. Richard Krimm of'_ FEMA provided interim findings that'this State Plan was adequate by letter ~ dated' November 17, '

During'the hearings it was also' indicated that the State was reviewing.

its Plan and would submit it for FEMA review'in July, 1982. Due to-ceveral-factors,-.'this State review and finalization of the Plan was not-

$Q Atomic Safety and Licensing April 18, 1984 Appeal Board completed until April, 1983, This State Plan was then issued in October, 1983. FEMA has convened the Regional Assistance Committee for review of this State Plan and expects the review to be completed in mid-May, 1984. Concurrently, the State Plan was also submitted to the Governor's Disaster Preparedness Council for review and recommenda-tion prior to submission to the Governor for his signature. After approval by this Council, the State plans to formally request FEMA approval under 44CFR350. For these reasons PGandE's appeal of the license condition imposed by the Licensing Board is not moot.

Notwithstanding the pendancy of the ongoing reviews of the State Plan, additional evidence confirming the adequacy of emergency preparedness at Diablo Canyon is now available. Since the 1982 full power hearings, there have been two successful full scale exercises of the Diablo Canyon Emergency Response Plan including applicable County and State participation.
