AFFIDAVIT OF C. T. BRANDT REGARDING WORKING CONDITIONS AND TREATMENT OF DARLENE STINER I, C. T. Brandt, hereby state and affirm that I am employed by Texas Utilities Generating Company as Civil / Mechanical QA/QC Supervisor and provide the following affidavit regarding Mrs.

Darlene Stiner, a QC Inspector at the Comanche Peak Site.

Mrs. Darlene Stiner is presently located in an office space, which she occupies alone, of approximately 100 square feet area.

, This facility is air conditioned and immediately adjacent to both her work area and another smaller building which houses another inspector and a trainee. She has access to the telephone in the fabrication shop (approximately 50 feet away).

No telephone is in her facility as no telephone extension is i

available on the existing switchboard.

Mrs. Stiner was moved to this facility after she had presented a memo from her doctor stating that due to her pregnancy she should avoid heavy lifting and stair climbing.

t Her current office facility is approximately 50 feet from her 2 work area, whereas if she was officed with the remainder of her group (and her immediate supervisor), she would be approximately 1/2 mile from her work area.

CASE!s allegation that Mrs. Stiner was " moved four times in the past two days from one end of the plant to the other" is false. She was moved only once. The proposed location was changed several times for various reasons, but due primarily to availability and location of temporary buildings. .The finhl decision resulted in the optimum office space in view of her current physical condition.

She is providing training to a trainee in her former duties and has been given other work to do as a result of her presentation of the memo from her doctor cautioning against heavy lifting and stair climbing. Her work area and area of responsibility (at the time of presentation of the note) was in the power block itself. Her duties encompassed inspeccion of Class V supports which involved climbing stairs and scaffolding on a daily basis.

Due to concern for her health, she was transferred to the structural fabrication shop, which involves neither stair nor scaffold climbing. As this inspection is a necessary function, we do not feel she is performing "less important work". It should be noted that her transfer has not resulted in a decrease in wages or benefits. .

She has been counselled that her search for documents is interferring with her normal work duties. She has also been counselled as to the extent of her options when it is no longer physically possible for her to continue work due to her pregnancy.

In summary, Mrs. Stiner has not been discriminated against due to her involvement in the July ASLB hearings. If anything, she has received preferential treatment in that she has a private t _ _ _ . _ _. .- - _ _ _ __ _ _. __m
