AFFIDAVIT OF ERIC H. JOHNSON I, Eric II. Johnson, being duly sworn, do depose and state the following:

1. I am the Director, Division of Reactor Fafety and Projects, in the Region IV office of the II.S. Nuclear Regulatory Commission. A copy of my professional qualifications is attached to this affidavit.
2. I have read CASE's Motion to Compel NRC Staff to Supplement Responses to Question 1 of CASE's 2/10/F2 First Get of Interrogatories and Rennents to Produce to NRC Staff (January 21, 1987). This affidavit responds to the statements in CASE's Motion regarding " trend anelyses" or " trend reports".
3. The last separate " trend analyses" or " trend report" for Comanche Peak was for the 1979 calendar year, and was issued by Region IV in January 1980. The Region discontinued the practice of preparing separate " trend analyses" or " trend reports" in 1980, after the i

trend report for calendar year 1979 was issued. Thereafter, any such i

trend analyses or reports were issued as part of Region IV inspection reports, Systematic Assessment of Licensee Performance (S ALP) reports, or other official documents.

4 There are no draft or otherwise unapproved " trend analyses" or

" trend reports" other than the analysis which was deleted from Inspection Report 85-07/05, as discussed in NRC Office of Investigator and Auditor (OIA) Report 86-10.

The statements above are true and correct to the best of my current knowledge and belief.

Professional Qualifications of Eric H. Johnson United States Nuclear Regulatory Commission I am Director, Division of Reactor Safety and Projects, Region IV, Nuclear Pegulatory Commission, Arlington, Texas. I have held this position in Region IV since November 1985. In this assignment, my responsibilities include reviewing, approving and performing routine and special inspections at nuclear facilities assigned to Region IV. In this position, I was responsible for managing the inspection program at the Comanche Peak Steam Electric Station, Comanche Peak Task Group.

I received a Bachelor of Science Degree, with honors, in marine engineering from the United States Naval Academy in 1967.

Prior Work History 1983-1985 Chief, Reactor Project Branch 1, Region IV Resporsible for managing the inspection program and assigned inspectors at both operating plants and plants under construction. This included recommendations and enforcement actions for deficiencies, and approval on NRC inspection reports for routine and special inspections. Participated in the Systematic Assessment of Licensee Performance as a member of the SALP board. For 3 months during 1983, served as the Technical Assistant to the Director, Division of Reactor Safety and Projects. (NRC) f

l 1982-1983 Enforcement Officer, Region IV Responsible for managing the enforcement program for the regional office, including review and analysis of inspection findings and recommendations for enforcement actions. Until a reorganization of functions in July 1982, supervised the activities of two investigators in the investigation of alleged wrongdoing at plants in the geographic area covered in RIV. (NRC).

1981-1982 Reactor inspector Served as a member of the technical staff of Region IV with responsibility for the inspection of assigned power, research and test reactors during test, startup and operation. (NRC) 1979-1981 Administrator, Nuclear Safety Division Responsible for organizing and coordinating the Secretariat's work in the areas of emergency core fooling research, containment safety, consequence rodelling and the International Standard Problems performed in these areas.

Acted as Secretary to the International Working Groups in these above areas.

(NuclearEnergyAgency,OECD, Paris, France) 1975-1981 Reactor Inspector Served as a member of the technical staff in Region IV with responsibility for the inspection of assigned power, research and test reactors during test, startup and operation. (NRC)

1967-1975 Reactor Operations Various supervisory responsibilities for naval nuclear propulsion plant operations. Duties included operation, training of operators, health physics, maintenance, planning and scheduling, and design changes.
