JOINT AFFIDAVIT OF DAN LURIE AND EVANGELOS MARINOS CLARIFYING OUR APRIL 4,1986 JOINT AFFIDAVIT ON STATISTICAL INFERENCES FROM CPRT SAMPLING We , Dan Lurie and Evangelos Marinos, being duly sworn, do depose and state as follows:

Q1. Messrs. Lurie and Marinos , are there any statements contained in your joint affidavit of April 4, 1986 that you now wish to clarify?

A1. Yes, a statement on page 19 and a statement contained in foot-note 19 of the same page of our April 4, 1986 affidavit require clarification.

Q2. What were the original statements and what clarifications would you like to make?

A2. In the first full paragraph on page 19 of our April 4, 1986 affida-vit, we stated:

The DAP permits the use of statistically-based sampling . Appendix A,Section II. A.3. However, none of the DSAPs currently call for the use of statistically- sampling as an evaluation methodology.gd c_f.

t We wish to make clear that DSAP VIII, Civil / Structural, calls for statisticaily-based sampling of Unit 1 and common conduit supports (CPRT Program Plan, DSAP VIII, Section 2.1, last paragraph), and that DSAP IX, Piping and Supports , calls for selection of small bore piping and supports to demonstrate the design adequacy, CPRT Program Plan, DSAP IX, Revision 1, Section 4.2.1.3, page 5.

These sections of the CPRT Program Plan do not clearly indicate whether or not sampling is to be statistically-based.

A statement in footnote 19 of our joint affidavit also requires correction and clarification. Footnote 19 stated:

The DAP also provides for the use of ISAPs to address external source issues on design matters. These ISAPs could potentially employ statistical sampling. Ilowever ,

there are no ISAPs for design issues in Revision 3 of the CPRT Program Plan.

We wish to point out that there are a number of ISAPs that address design issues, or otherwise use engineering analyses of construction issues as one of the elements of the CPRT's review.
