BOARD NOTIFICATION NO. 87- 09 FOLLOWUP GF BOARD NOTIFICATION NOS.85-067, 85-076, AND 86-20 REGARDING OFFICE OF INVESTIGATIONS REPORT NO.

4-85-008 - THE FACTS SURROUNDING TEXAS UTILITIES UNTIMELY RESPONSE TO THE INTERVENORS DISCOVERY REQUEST In Board Notification No. 86-20, the staff provided you with Office of Inves-tigation (0I) Report No. 4-85-008 which examined the circumstances surrounding the failure of Texas Utilities Electric Company to provide the Management Analysis Company report on a timely basis to a discovery request by the intervenor. OI concluded that the intervenor's interrogatory was sufficiently well-defined to reach the report at issue; the utility made a material false statement by omission of the report in response to the intervenor's request; however, the omission was not made with the intention of violating the ASLB's order.

In order to followup on previous Board Notifications this is to inform you that the staff,after consulting with the Commission, is takino no enforcement action regarding the matter reported on by 01 in report no. 4-85-008.

The parties to the proceeding are being notified by copy of this memorandum.
