UPDATE OF PROPOSED LICENSE CONDITION FROM SAFETY EVALUATION REPORT RELATED TO THE LICENSE RENEWAL OF PILGRIM NUCLEAR POWER STATION (TAC NO. MC9669)

Dear Mr. Balduzzi:

By letter dated January 25,2006, Entergy Nuclear Operations, Inc. (Entergy) submitted an application pursuant to Title 10 of the Code of Federal Regulations Part 54 (10 CFR 54),

'Requirements for Renewal of Operating Licenses for Nuclear Power Plants;' to renew operating license DPR-35 for the Pilgrim Nuclear Power Station (PNPS).

The U.S. Nuclear Regulatory Commission (NRC or the staff) reviewed the renewal application for compliance with the requirements of 10 CFR Part 54, and issued its findings in NUREG-1891, "Safety Evaluation Report Related to the License Renewal of Pilgrim Nuclear Power Station:' on June 28,2007. The NRC staff published Supplement 1 to the safety evaluation report (SER) in September 2007, which documented the safety review results of clarifications submitted by PNPS concerning confirmatory environmentally adjusted fatigue cumulative usage factors analyses for limiting reactor components. The NRC staff later published Supplement 2 to the SER in June 2011, which documents the staffs review of additional information provided by Entergy in annual updates and license renewal application amendments since the issuance of Supplement 1 to the SER.

NUREG-1891, Section 1.7, documents a proposed license condition as shown below:

The fourth license condition, identified as License Condition 4.2.6, requires that on or before June 8, 2010, the applicant will submit to the NRC correctly benchmarked RV neutron fluence calculations, consistent with RG 1.190, that will confirm that the neutron fluence for the lower intermediate shell axial welds, at the inner surface of the RV, will not reach the limiting value of 3.37 x 10 n/cm (E> 1.0 MeV) by the end of the period of extended operation (54 EFPY).

By letter dated January 24, 2010, as supplemented by letters dated September 7 and November 4, 2010, Entergy submitted the information referenced in the above proposed license condition as part of a license amendment request (LAR). The staff approved the LAR as documented in its safety evaluation dated January 26, 2011. Therefore, this proposed license condition is no longer necessary and will not be considered during the completion of the license renewal review process.
