Dear Mr. Weber:

In accordance with 10 CFR 50.54 (q) , this letter notifies the NRC that Public Service Company of Colorado (PSCo) has adopted the Fort St. Vrain (FSV) Independent Spent Fuel Storage Installation (ISFSI)

Emergency Response Plan to direct emergency response for the FSV site, including the FSV plant, as discussed in Reference 1. PSCo has determined that changes to the FSV emergency response plan, detailed in Reference 2, do not decrease the effectiveness of 7 emergency response for the decommissioned FSV plant. g

• P-9 6096 November 14, 1996 Page 2 PSCo has completed dismantlement and decontamination of its FSV plant, and recently submitted the last of the final survey reports (Reference 3) to the NRC, documenting cleanup of residual radionuclides to levels meeting the specified unrestricted releasa criteria. In Reference 4, PSCo requested termination of the 10 CFR Part 50 FSV Facility Operating License.

With decommissioning activities complete, accidents resulting in the release of significant quantities of radioactivity from the FSV plant are not possible. As discussed in Reference 1, PSCo considers that the FSV ISFSI Emergency Response Plan, recently approved by the NRC in Reference 5, provides adequate emergency response for credible radiological accidents which could occur at the FSV site with the FSV plant in its decontaminated status. PSCo has adopted the ISFSI Emergency Response Plan to direct emergency response for radiological accidents that could occur at the FSV site, until the 10 CFR Part 50 license is terminated. PSCo considers that use of the ISFSI Emergency Response Plan will provide a conservative means of dealing with radiological accidents that could occur at the FSV site, since the only potential source for release of significant quantities of radioactivity is the ISFSI.
