DETERMINATION OF ACCEPTABILITY AND SUFFICIENCY FOR DOCKETING AND OPPORTUNITY TO REQUEST A HEARING REGARDING THE APPLICATION FOR RENEWAL OF THE GE-HITACHI NUCLEAR TEST REACTOR (EPID NO. L-2020-RNW-0038)
Dear Mr. Martinez:
By letter dated November 19, 2020 (Agencywide Documents Access and Management System Accession No. ML20325A193), as supplemented by letters dated September 10, 2021 (ML21211A617), September 22, 2021 (ML21265A246), April 22, 2022 (ML22112A236), and September 15, 2022 (ML22258A117), GE-Hitachi Nuclear Energy Americas, LLC submitted a license renewal application (LRA) for a 20-year renewal of the Class 104c Facility Operating License No. R-33 for its Nuclear Test Reactor.
Based on its initial review of the application, as supplemented, the U.S. Nuclear Regulatory Commission (NRC) staff has determined that GE-Hitachi Nuclear Energy Americas, LLC has submitted sufficient information in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 50.33, Contents of applications; general information, and 10 CFR 50.34, Contents of applications; technical information, to enable the staff to undertake a review of the application, and that the application is therefore acceptable for docketing. Information pertaining to the opportunity to request a hearing can be located in 10 CFR 2.309, Hearing requests, petitions to intervene, requirements for standing, and contentions. The determination to accept the application for docketing does not constitute a determination that a renewed license should be issued and does not preclude the NRC staff from requesting additional information as the review proceeds. The Notice of Acceptability for Docketing of Application and Opportunity to Request a Hearing and Order Imposing Procedures for Access to Sensitive Unclassified Non-Safeguards Information is being forwarded to the Office of the Federal Register for publication.
