Dear Michelle Catts:

By letter dated July 27, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML23191A859), the U.S. Nuclear Regulatory Commission (NRC) staff informed you of its acceptance, for detailed technical review, of General Electric Company (GE), GE-Hitachi Nuclear Energy Americas, LLC (GEHA), and Global Nuclear Fuel-Americas, LLCs (GNF-A) (together, applicants) application requesting consent from the NRC for the indirect transfer of control of reactor, materials, and export licenses held by GEHA and GNF-A, and notification regarding other approvals.

Enclosed to the letter, the NRC staff provided observations on information that the NRC staff could potentially request later. In the letter, the NRC staff noted that the observations were provided to allow the applicants to start working early on those items and that the observations were not the result of a detailed technical review. The NRC staff further stated that responses to the observations were not required for proceeding with detailed technical review of the application, but that the applicants may supplement the application, if desired, before the NRC staff formally made any requests for additional information (RAI). By letter dated August 17, 2023 (ML23229A512), the applicants provided supplemental information addressing the observations provided by the NRC staff in the July 27, 2023, acceptance letter.

The NRC staff has completed its review of the supplemental information and determined that the responses adequately address the observations in the acceptance letter. Based on this determination, the NRC staff has also decided that no other RAIs will be issued regarding the application. The NRC staff will move forward with the technical review of the application with a final response issued by mid-November 2023, as it was communicated to you in the acceptance letter. We will promptly notify you if significant schedule or cost changes happen or are needed.

In accordance with Title 10 of the Code of Federal Regulations Section 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the October 13, 2023
