On June 1, 2023, General Electric Company (GE), GE-Hitachi Nuclear Energy Americas, LLC (GEHA) and Global Nuclear Fuel-Americas, LLC (GNF-A) (together, "Applicants") submitted an Application for Order Consenting to Indirect Transfer of Control with Respect to Reactor Licenses, Materials Licenses

M230159 U.S. NRC December 4, 2023 Page 2 of 2 and Export Licenses, and Notification Regarding Other Approvals ("Application") (Reference 1 ). The N RC accepted the Application for technical review on July 27, 2023 (Reference 2). On August 17, 2023, Applicants supplemented the Application by submitting responses to each of the NRC Staff's observations that were enclosed with the NRC's acceptance letter (Reference 3). On September 27, 2023, Applicants further supplemented the Application by providing information on the principal officers of GE Vernova Corp. (Reference 4). On November 30.2023 NRC issued order EA-23-132 approving the indirect transfers of control of licenses (Reference 5)

The purpose of this letter is to provide additional information to the Application. Specifically, in the Application, Applicants stated that they would provide the names of the board members for GE Vernova Corp. when those individuals are identified. Attached is a Revised Exhibit D, which lists the board members for GE Vernova Corp.

(1) I am the Manager, Facility Licensing, of GE-Hitachi Nuclear Energy Americas, LLC (GEHA), and have been delegated the responsibility of reviewing the information belonging to GEHA described in paragraph (2) which is sought to be withheld, and have been authorized to apply for its withholding from public disclosure.

(2) The personally identifiable information requested to be withheld from public disclosure is contained in of GEHA's letter, Scott P. Murray to U.S. NRC Document Control Desk, Letter No. M230159, entitled Additional Information to GEHA and GNF-A Application for Order Consenting to Indirect Transfer of Control (Reference 1 ), dated December 4, 2023. In the above-cited Attachment 3, those pages requested to be withheld are marked with the designation "Contains Personally Identifiable Information - Withhold Under 10 CFR 2.390" or similar notice at the top of each page. In addition, the Personally Identifiable Information (PII) the PII is denoted by the text "(PII)" placed adjacent to such information.

(3) In making this application for withholding of confidential information, GEHA relies upon the exemptions from disclosure set forth in the Privacy Act of 1974, 5 USC Sec. 552a(b), the Freedom of Information Act ("FOIA"),

5 USC Sec. 552(b)(6), and NRC regulation 10 CFR 9.80. The material for which exemption from disclosure is here sought is "personally identifiable information" as defined in the NRC's Personally Identifiable Information Breach Notification Policy (ML083650337) and the document being submitted is a "record" containing PII within the meaning assigned to that term in the Privacy Act of 1974 and 10 CFR 9.51, and a "file" within the meaning of that term in FOIA exemption 6. The document should be withheld pursuant to 5 USC 552a(b) and 5 USC 552(b)(6), and the policy reflected in 10 CFR 9.80 and 10 CFR 2.390(a)(6) because:

a.

This information is and has been held in confidence by GEHA.

b.

The information is of a type that is held in confidence by GEHA, and there is a rational basis for doing so because the information that can be used to identify or contact a person uniquely and reliably, can be traced back to a specific individual, or contains information that would make the individual's identity easily discernible or traceable.
