Dear Mr. Kohn This refers to the April 7, 1994, meeting with you, your client Allen Mosbaugh, members of the Region II allegations and investigation staffs and me concerning allegations your client wished to give the NRC. You indicated in the course of the meeting that the allegations relate to issues presently before the licensing board (Georgia Power Company license transfsr proceeding) and have potential health and safety significance.

Before conveying the substance of his allegations, Mr. Mosbaugh made a request for confidentiality. You stated that confidentiality was being sought to preserve the integrity of any potential investigation the NRC s Office of Investigation (OI) might open in response to the information provided and to prevent the information from being divulged to Georgia Power Company counsel in the event a board notification was required.

After review of your client's request for confidentiality, your bases for the request, the other relevant matters discussed during the meeting and a briefing among agency senior staff, it has been determined that a grant of confidentiality is inappropriate. You do not claim that confidentiality is necessary to protect the identity of an informant.

In addition, a= yvu are w.ll aware, the Mnc deter =1r.ec whether -- dsspite the obligations of participants to NRC proceedings to notify the board and parties of information that is relevant and material to an admitted issue in a proceeding -- information should be withheld from the parties (and presented to the board in camera) pending completion of an investigation or inspection.

See " Statement of Policy; Investigations, Inspections, and Adjudicatory Proceedings," 49 Fed. Reg. 36,032 (1984). The Staff cannot make that determination until it has had the opportunity to hear and evaluate an allegation. Consequently, your request to withhold the information cannot be granted in advance of receipt and analysis of your client s allegations.

However, because you have characterized the information as having potential safety significance, it is absolutely imperative that it be provided to the NRC for review and appropriate action. Accordingly, you are requested to provide the information,to the NRC Region II Allegations Coordinator within

Dear Mitzi and Carolyn:

I am writing in response to Carolyn Evans letter of April 8, 1994, concerning Mr. Mosbaugh's desire to provide information to your agency. As you are aware, on April 7, 1994, Mr. Mosbaugh and his counsel attempted to provide information to the NRC but were unable to do so inasmuch as we could not work out a procedure to protect Mr. Mosbaugh's attorney-client and work-product privileges. .

As I have discussed today with Carolyn Evans, who generally seemed I I

to be in agreement, Mr. Mosbaugh and his counsel offered to provide information to your agency on the following conditions:

(1) Your agency agrees that it will protect Mr.

Mosbaugh's attorney-client and work-product privileges to the ,

fullest extent possible and that the release of information, by Mr. l Mosbaugh, to the fullest. extent permitted by law, will not I l

constitute a waiver of these privileges.

(2) Before a Board Notification is filed, Mr. Mosbaugh and his counsel will be given notice of five (5) working days.to negotiate with your agency to word the Board Notification as to not offend Mr. Mosbaugh's attorney-client and work-product' privileges or to otherwise allow sufficient time to submit a motion of protective order concerning these privileges.

Dear Mr. Kohn:

Rt: Meeting of April 7, 1994 with A. Mosbaugh et al.

This responds to our telephone conversation of April 12, 1994, regarding your client, Alan Mosbaugh's provision of information to the NRC. During the course of this conversation, you requested that, in the event a board notification'is required, you be given an opportunity (in advance of the notification) to prepare a motion for a protective order to prevent the disclosure of work product or information protected by the attorney client privilege. I agreed to advise hearing counsel and other appropriate offices responsible for board notifications of your request. This constituted the sum and substance of our conversation.

On April 12, 1994, a letter memorializing our telephone conversation of the same date was faxed to my office. This letter contained additional conditions that were not discussed or agreed to by me. Your assertion that I " generally seemed to be in agreement" with these conditions is factually untrue. Upon hearing of the content of your letter, I immediately called you and expressed concern regarding your mischaracterization of the substance of our conversation. You indicated that the conditions set forth in your letter were in general, of the same nature as the one issue we discussed and that you would need them agreed upon before your client provided the information to the agency.

After discussing this matter with hearing counsel and the NRC staff, we have decided not to alter the terms of my April 8, 1994 letter to you. Inasmuch as this letter was hand delivered to you on Saturday, April 9,1994, we expect your client to provide the information to the NRC by Monday, April 18, 1994.
