Dear Mr. Johnson:

I have tried to reach you by telephone today, but your answering machine advises that you are not in your office.

I am therefore writing to respond to your telephone inquiry of yesterday. You asked whether Applicants would consent to a one week extension of time for Joint Intervenors to file a pleading in response to the Board's October 3 order dismissing the quality assurance contention (Contention 8). I indicated that I would discuss this with my clients and advise you yesterday afternoon or this morning of Applicants' position.

Having considered the matter carefully, Applicants are not now in a position to advise you whether they can waive any timeliness objections that might be available to them with respect to your pleading. Such a determination cannot be made by us until we have received your paper and reviewed its contents. If such a waiver then seems appropriate, we will so advise and conduct ourselves accordingly.
