D6 January 14, 1986 EN 85-57A 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Florida Power and Light Company (Turkey Point, Units 3 and 4)

IMPOSITION 0F CIVIL PENALTY - $100,000 By EN-57 dated August 15, 1985 the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Hundred Thousand Dollars ($100,000) to Florida Power and Light Company. This action was based on the failure of the licensee's staff to determine whether a modification to the spent fuel pits (SFP) piping created an unreviewed safety question. This failure resulted in the operation of SFP systems for several years in a different manner than that described in the Final Safety Analysis Report.

The licensee responded to the Notice in a letter dated September 19, 1985. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty and that mitigation of the proposed civil penalty is not warranted. Accordingly, an Order Imposing Civil Penalty in the amount of One Hundred Thousand Dollars $100,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
