EN 86-25A OFFICE OF' INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Florida Power and Light Company, Juno Beach, Florida (Turkey Point Units 3 and 4)

IMPOSITION OF CIVIL PENALTY - $25,000 By EN 86-25 dated April 23, 1986 the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) to Florida Power and Light Company.

This action was based on an unauthorized entry of a plant worker into a locked high radiation area. The event occurred on January 8, 1986 when the individual entered the Traversing Incore Probe (TIP) area to perforn, maintenance on a

, TIP drive unit. During the entry, numerous procedural violations occurred

including failure to notify health physics personnel prior to operation of the incore detectors, performing work outside the scope of the plant work order, failure to have two persons present during the entry, and failure to keep the worker's exposure within the limits established by the radiation work permit for the job. Although the exposure received by the individual during the entry was not in excess of NRC limits, a substantial potential for such.

an exposure existed.

The licensee responded to the Notice in a letter dated May 28, 1986. After careful consideration of the licensee's response, the staff has concluded that the violations occurred as stated in the Notice of Violation and Proposed Imposition of Civil Penalty and that the violations were correctly categorized as a Severity Level III problem. However, a sufficient basis also exists for mitigating the proposed $50,000 civil penalty by 50 percent based on the ljcensee's extensive corrective actions. Accordingly, an Order Imposing a Civil Monetary Penalty in the amount of Twenty-Five Thousand Dollars has been issued today.

Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
