hb August 12, 1986 EN 86-63 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Florida Power and Light Company (Turkey Point, Units 3 and 4)

Docket No. 50-250 and 50-251 Subjec't: PROPOSED IMPOSITION OF CIVIL PENALTIES - $300,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of Three Hundred Thousand Dollars

($300,000) will be issued today to Florida Power and Light Company. This action is based on violations identitied during IE and Region II inspections that focused on the Auxiliary Feedwater (AFW) System. The violations involved failures to satisfy Technical Specification and 10 CFR 50.59 requirements, and to ensure that safety activities were performed in accordance with adequate procedures. Weaknesses in the licensee's design control and corrective action programs were also identified. In addition to the civil penalties, an Order will also be issued to confinn commitments for a comprehensive reassessment and examination of other plant safety systems to determine whether problems exist similar to those identified in the AFW system.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Director, Office of Inspection and Enforcement, has been authorized by the Commission to sign this action. The schedule of issuance and notification is:

Mailing of Notice August 12, 1986 Telephone Notification of Licensee August 12, 1986 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Florida will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
