PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed 1
Imposition of Civil Penalty in the. amount of Seventy-Five Thousand Dollars

($75,000) will be issued on or about July 28, 1987 to Florida Power and Light q
Company.
This action is based on two violations:
(1) the failure to maintain j
positive access control over personnel and equipment and (2) the failure to i
perform an adequate vehicle search.
The civil penalty is being increased by l
50 percent because of the licensee's poor prior performance.
Specifically, I
both violations involve security personnel failures in the area of access i
control.
These incidents are similar to violations cited in the Notice of Violation and Proposed Imposition of Civil Penalty issued to the licensee on April 21,1987.

It should be noted that the licensee has not been specifically informed of the enforcement action.
The Regional Administrator has been authorized by the Deputy Executive Director for Regional Operations to sign this action.
The schedule of issuance and notification is:
s Mailing of Notice July 28, 1987 Telephone Notification of Licensee July 28, 1987 A news release has been prepared and~will be issued after the licensee receives the Notice.
The State of Florida will be notified.
l The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
