Dear Mr. Felton:
Pursuant to the Freedom of Information Act, 5 U.S.C. 52 2, a s amended, the Environmental Task Force requests all information, results of tests and reports of tests done in the vicinity of the Oyster Creek nuclear power plant f or radiation in air, soil or water. In addition, I would like to request any records or portions thereof that pertain to or refer in any way to such tests or to the existence of such tests.
I hereby request that you waive search and duplication charges, pursuant to 5 U.S.C. 552(a)(4)(A) "because furnishing the information can be considered as primarily benefitting the general public." The Environmental Task Force is a non-profit organization whose primary objective is to serve Ame r ic a's grassroots environmental groups. Information sought pursuant to this request will be used to address citizens' concerns about the environmental impacts of the Oyster Creek generator.
As you know, the Freedom of Information Act provides that if portions of a document are exempt f rom release, the remainder must be segregated and disclosed. Theref ore, I will expect you to send me all nonexempt portions of the records which I have requested, and ask that you justify any deletions by reference to specific exemptions to the Freedom of Information Act. I reserve the right to appeal your decision to withhold any materials.
