  • you requested that the U.S. Nuclear Regulatory Commission (Commission or NRC) supplement your 2.206 petition dated September 22, 1996, which is currently being considered by the NRC. In your September 22, 1996, 2.206 petition, you requested that the NRC shut down the SONGS units as soon as possible pending a complete review of the seismic design of the SONGS units based on the new information gathered from the Landers and Northridge quakes. The NRC denied your request that the Commission immediately shut down the SONGS units for the reasons contained in our reply dated November 22, 1996.

In your April 25 e-mail.to NRC Chairman Jackson, you specify your (.oncerns about the ability of the San Onofre Nuclear Generating Station (SONGS) steam generators to withstand a major seismic event. Specifically, you stated that the ability of the SONGS steam generators to withstand a major seismic event is seriously compromised by the degradation recently observed in the SONGS Unit 3 steam generator internal tube supports (oggerate supports . You requested an investigation to determine if Unit 2 has experienced degra)dation similar to-that found in Unit 3. You also stated that further seismic analysis should be performed for the SONGS steam generators and that-a retrofitting upgrade of the steam generator supports could be accomplished at I this time. The staff will treat this request separately from your original i 2.206 petition. The basis for this decision is that this concern is related  !

to the seismic adequacy of a specific structure, whereas the concern expressed )

in your September 22 petition was with the adequacy of the seismic load definition for the SONGS site.

The licensee has recently completed an evaluation of the oggerate supports and has concluded that operation with the degraded oggerate supports will not result in an unreviewed safety question as defined by Section 50.59 of Title

-10 of the code of Federal Reaulations (10 CFR 50.59). (A copy of 10 CFR 50.59 is enclosed for your information). Th1s 10 CFR 50.59 safety evaluation, a  !

copy of which is enclosed, is contained in a letter dated June 5 -1997, from i Dwight E.- Nunn, Southern California Edison Company, to_ the NRC, that forwarded /

a comprehensive evaluation of the SONGS Unit 3 steam generator oggerate /

supports. This report, which contains material referenced in the 10 CFR 50.59 safety evaluation, is available in the Local Public Document Room located at

'the Nain Library, University of California, P.O. Box 19557, Irvine, California (/

92713. Section 50.59 defines the conditions under which reactor licensees may  %[i make changes to their facilities or procedures without prior NRC approval,-and 10 CFR 50.59 may be used to evaluate the implications of unintended changes, e.g., the degraded eggerate supports, on continued plant operation.

l The staff is reviewing the licensee's evaluation as part of its normal review of the 10 CFR 50.59 process for this licensee and will provide its final evaluation in a future inspection report. This review includes evaluating the licensee's analyses and conclusions related to the ability of the oggerate

. supports to perform their intended desi n-basis function following a postulated seismic event concurrent wit the most limiting design-basis accident. On the basis of its review to date, the staff ans not identified any deficiencies in the licensee's analysis of the seismic adequacy of the  :

-substant<al hazard to public health and safety that warrants immediate action. l Although your request for insnediate action is denied, the NRC will continue to evaluate the matters that you have raised as part of its ongoing review of the

- licensee's 10 CFR 50.59 evaluation.

Your request has been referred to me pursuant to 10 CFR 2.206 of the Commission's regulations. As provided by 10 CFR 2.206, action will be taken on your request within a reasonable time. I have enclosed for your infomation a copy of the notice that is being filed with the Office of the
