SUBJECT: CORRECTIONS TO NRC SPECIAL INSPECTION REPORT 50-361; 362/98-18

This letter responds to your letter dated February 16,1999, in which you identified several

inaccuracies within NRC inspection Report 50-361; 362/98-18. Those comments with which we

agree are incorporated into revised pages of NRC Inspection Report 50-361; 362/98-18, which

are enclosed with this letter. Please make a page-by-page replacement of the enclosed pages

with those in the subject inspection report. Those comments with which we disagree are

discussed below.

In the attachment to your letter, in reference to both the Executive Summary and

Section 08.1.b.3, you stated "The September Emergency Chiller inoperability was from

September 4,1998 rather than September 3,1998 as stated. (Please note: Section 08.1.b.1

, states correctly that the inoperability was from September 4,1998)." We disagree with this ,

statement because on September 3,1998, the chiller low temperature cutout switch was

'

inadvertently miswired, which rendered the emergency chiller inoperable. The reference to

September 3,1998, denoted the date of the error. The reference to September 4,1998,

denoted the date that the emergency chiller was declared inoperable by Operations but, in fact,

was already inoperable,

in reference to the second paragraph of Section E8.1.b.1 you stated the following: j

-The first sentence of the paragraph describes the requirements for the use of a

nonconformance report (NCR) to accept a condition "as-is" and justify that the

configuration continues to satisfy design requirements. The paragraph goes on

to say that utilization of an NCR [rather than an Operability Assessment (OA)) in I,'

principle, would have caused increased engineering attention to the design of the ,

chiller and the effect of the degradation on the chiller. SCE does not disagree

with the assertion that an NCR in principle would have received increased ';

attention, however, based on the conditions described in the Action Request i

(AR) and the actions outlined in the initial Field Support assignment of the AR,

SCE believes an OA was the appropriate mechanism to evaluate the condition.

The initial Field Support assignment indicated that there was a need to have the

HVAC group investigate the thermostat setting, chilled water sensor and the

control module. Therefore, there was no intention of accepting the condition

"as-is." SCE concurs, however, that the OA was not accomplished in

accordance with Procedure SO123-XX-1 and the inadequate OA resulted in a

failure to promptly identify and correct a condition adverse to quality.  !

, We thank you for the above comment; however, we conclude that no correction to

Section E8.1.b.1 of NRC Inspection Report 50-361; 362/98-18 is necessary. Your comment

provides additional information that is not contradicted by the inspection report.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter will be

placed in the NRC Public Document Room.
