NRC INSPECTION REPORT 070-00036/98005(DNMS) AND NOTICE OF VIOLATION

Dear Dr. Kaiser:

. On November 6, .1998, the NRC completed a routine, announced inspection of operational safety,' training, transportation safety, and management organization and controls at your Hematite facility. The purpose of the inspection was to determine whether activities authorized

~ by your license were conducted safely and in accordance with NRC requirements.

During the inspection, the conduct of activities observed at the Hematite facility was generally

- characterized by the effective implementation of applicable requirements. However, based on the results of the inspection, the NRC has determined that a violation of NRC requirements .

occurred. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violation and examples are described in detail in the enclosed report.' The violation is of concern because it indicates a lack of attention to detail in the ]

' implementation of posted criticality safety controls for routine operations in the plant. The . 1 violation is also of concern because it is similar to the procedural compliance problems - '

identified by the NRC in the last routine inspection Report 070-00036/98004(DNMS). Because

- the cited examples were promptly corrected and actions taken to prevent' recurrence, a response to the Notice is not required. However, the NRC will closely monitor your response and corrective actions for inspection Report 070-00036/98004(DNMS) and the approach taken by yes investigation team to address the generic aspects of these posting and procedural compliance issues.
