4 ENCLOSURE 1 NOTICE OF VIOLATION STP Nuclear Operating Company Docket No.: 50-499 South Texas Project Electric Generating Station License No.: NPF-80 1

During an NRC inspection conducted on November 2-5,1998, one violation of NRC require'nents was identified. In accordance with the " General Statement of Policy and Proceoure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR 20.1501 requires that each licensee make or cause to be made surveys that may be necessary for the licensee to comply with the regulations in Part 20 and that are reasonable under the circumstances to evaluate the extent of radiation levels, concentrations or quantities of radioactive materials, and the potential radiological hazards that could be present.

Pursuant to 10 CFR 20.1003, survey means an evaluation of the radiological conditions and potential hazards incident to the production, use, transfer, release, disposal, or presence of radioactive material or other sources of radiation.

Contrary to the above, the licensee did not make surveys to ensure compliance with 10 CFR 20.1902 which requires the posting of each radiation area with a conspicuous sign or signs bearing the radiation symbol and the words " CAUTION, RADIATION AREA." Specifically, between October 29 and November 2,1998, the licensee failed to evaluate the radiological conditions and potential hazards present following the t;ansfer of steam generator nozzle dams into storage containers resulting in a radiation area not i being properly posted. i This is a Severity Level IV violation (Supplement IV) (50-499/98020-01). 1 The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in this inspection report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or i your position. In that case, or if you choose to respond, cleaily mark your response as a " Reply  ;

to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commicsion, j ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident inspector at the facility that is the subject of this Notica, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
