NOTICE OF VIOLATION i

.J NPF-80 During an NRC inspection conducted September 26 through November 6, 1993, one h

violation of NRC requirements was identified.

In accordance with the " General i

Statement of Policy and Procedure for NRC Enforcement-Actions," 10 CFR Part 2, j

Appendix C, the violation is listed below:

Technical Specification 6.8.1.a states, in part, that written i

procedures shall be established, implemented, and maintained including the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Item 9.a of f

Appendix A states, in part, " Maintenance that can affect the performance of safety-related equipment should be properly preplanned and performed in accordance with written procedures, documented instructions, or drawings appropriate to the j

circumstances."

This requirement was implemented, in part, by Procedure MNP-1004, j

" Freeze Stop Procedure," Revision 1.

Step 4.10.9 states, "Upon i

reaching the freeze stop temperature outside the jacket at the i

thermo-couple record the time, inspect the jacket, notify the i

customer freeze stop plug and release pipe for work to be done by customer."

Contrary to the above, at or about 5:05 a.m. on October 13, 1993, i

the contractor technician notified licensee personnel that a i

freeze plug had been established, and Progress Record Sequence 85 l

of Work Package 308833-EP01 was signed off, thereby releasing the pipe for work, without achieving the freeze stop temperature outside the jacket. Testing later verified that the freeze plug

had not been established.

within 30 days of the date of the letter transmitting this Notice of Violation-(Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the j

violation, or if contested, the basis for disputing the violation, (2) the corrective steps which have been taken and results achieved, (3) the 93120B0038 931202

If an adequate reply is not received within the time specified in_this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause j

is shown, consideration will be given to extending the response time.
