CONFIRMATORY ORDER MODIFYING LICENSE (EFFECTIVE IMMEDIATELY) AND EXERCISE OF DISCRETION This is to inform the Comrnission that the NRC will issue a Confirmatory Order Modifying License (Effective Immediately) and exercise discretion in accordance with Section Vll.B.6 of the Enforcement Policy to not issue a Notice of Violation or propose a civil penalty to STP Nuclear Operating Company (licensee) for a violation of 10 CFR 50.7 requirements.

The violation involves the licensee subjecting four employees to a hostile work environment created by a former manager in retaliation for the employees engaging in protected activities. The Confirmatory Order is being issued to confirm the licensee's commitments, as set forth in Section V of the Order, and to ensure that the licensee's process for addressing employee protection and safety concerns are enhanced. However, the staff has concluded that further enforcement action is not warranted and that discretion under Section Vll.B.6 of the Enforcement Policy should be exercised because 1) the licensee settled the four employee protection complaints prior to an evidentiary hearing before, and prior to a finding that discrimination had occurred by, the United States Department of Labor; 2) the licensee took particularly good corrective actions as outlined in the Order; 3) the licensee has planned actions to monitor the safety environment and to promote an atmosphere conducive to the raising of safety concerns by employees without fear of retaliation; and 4) the licensee's overall sustained performance in the area of employee protection has been good, it should be noted that the licensee has been specifically informed of the enforcement decision and has accepted the commitments stated in the Order in accordance with a letter from the licensee's attorney, dated May 29,1998.
