Dear Michael:

In your recent responses to GPC's requests for admissions, (

you object to the admissibility by Licensee of portions of tape .

recordings or transcripts for the truth of the matter asserted  !

therein with. respect to statements by GPC employees. You sug- I gest, however, that any such statements may be introduced by l Intervenor as admissions.  !

This type of gamesmanship does nothing to advance this pro- i ceeding. The tapes and transcripts are important evidence and all relevant portions should be admissible for the truth of the matters asserted therein. Because the recordings are contempora- r neous and the participants (with the exception of Mr. Mosbaugh) i were unaware that they were being recorded, they should be deemed l sufficiently reliable. Quite frankly, the only person who had j any reason not to be candid during the recorded conversations was  ;

Mr. Mosbaugh, because he was the only person who knew that the  !

conversations were being recorded. l

Please note that recorded statements by GPC employees are not admissions by GPC. We are.nevertheless willing to allow 'i relevent recorded statements to be introducted into evidence,  !

although they may technically be hearsay, so that the Board can i hear all the evidence. We believe and expect, however, that all l such statements--those supporting your views and those supporting j l
