SUBJECT:
SUMMARY OF FEBRUARY 24, 2015, MEETING WITH ENERGY NORTHWEST REGARDING A PLANNED RELIEF REQUEST FOR THE REACTOR WATER CLEANUP SYSTEM (TAG NO. MF5679) On February 24, 2015, a Category 1 public meeting was held with the U.S. Nuclear Regulatory Commission (NRC) and representatives of Energy Northwest (the licensee). The purpose of the public meeting was for Energy Northwest to present a planned relief request submittal for the Reactor Water Cleanup (RWCU) System at Columbia Generating Station. The meeting notice and agenda is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML 15054A022. A list of attendees is provided as Enclosure 1. Energy Northwest presented its planned relief request (slides and figures,_presented are available at ADAMS Accession No. ML 15054A473), which would request relief for certain components in the non-safety related portions of the RWCU system, which do not conform to the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (Code) design requirements, on the basis that they perform with an acceptable level of quality and safety. The licensee presented an overview of the system, the history of the ASME classification of the system, recent enforcement actions regarding the reclassification of the system by Energy Northwest, and the planned request for relief for a total of 41 RWCU system components, which do not currently meet ASME Code, Section Ill, Class 3 design requirements. The NRC staff expressed concern over the proposed path forward from the licensee, specifically whether pursuing a relief request is the correct course of action for this situation. The NRC staff noted that in July 2013, the licensee had received a Severity Level IV no.n-cited violation of Title 10 of the Code of Federal Regulations ( 10 CFR) Section 50. 59, "Changes, tests, and experiments," because the licensee failed to obtain a license amendment, pursuant to 10 CFR 50.90, prior to reclassifying the system in 1995 from ASME Code, Section Ill, Class 3, to Quality Group D (American National Standards Institute (ANSI) Standard ANSI B31.1 ). The NRC staff noted that it would need more information and additional time to consider the appropriate course of action for the licensee to pursue. The NRC staff also noted that the Office of Nuclear Reactor Regulation does not normally approve requests for relief from ASME Code, Section Ill, as this section contains the rules for the design and construction of nuclear power plant facility components, and Columbia Generating Station is an operating plant, which has already been constructed, and is not building a new system.
Energy Northwest stated that it understood the NRC staff's questions and concerns and needed to discuss internally to decide how best to proceed with a licensing action to correct the July 2013 non-cited violation regarding the RWCU system.
