SUMMARY

OF MARCH 31, 2021, PRE-APPLICATION TELECONFERENCE WITH ENERGY NORTHWEST TO DISCUSS A PLANNED LICENSE AMENDMENT REQUEST FOR COLUMBIA GENERATING STATION REGARDING DELETION OF CERTAIN LICENSE CONDITIONS RELATING TO LICENSE RENEWAL COMMITMENTS (EPID L-2021-LRM-0030)

On March 31, 2021, an Observation public teleconference was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Energy Northwest (the licensee).

The purpose of the meeting was to discuss a proposed license amendment (LAR) request for Columbia Generating Station (Columbia). The proposed LAR would remove license conditions relating to license renewal commitments. The meeting notice and agenda, dated March 15, 2021, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML21084A139. The slide presentation provided by the licensee is available in ADAMS at Accession No. ML21081A181. A list of attendees is enclosed.

The licensee stated that License Conditions 2.C(34) and 2.C(35) of the Columbia Renewed Facility Operating License (RFOL), could be interpreted to require the licensee to manage commitments made during the license renewal application review under the Title 10 Code of Federal Regulations (10 CFR) Section 50.90, Application for amendment of license, construction permit, or early site permit, license amendment process instead of under the 10 CFR 50.59, Changes, tests, and experiments, Final Safety Analysis Report (FSAR) update process, as the NRC staff had intended. The licensee stated that they have incorporated Table A-1 of the Columbia Final Safety Evaluation Report, which lists the license renewal commitments in question, into Appendix A of the Columbia FSAR. This places Columbia within the 10 CFR 50.59 change process, which the licensee contends that it fulfills the intent of the license conditions and makes them obsolete. The licensee also stated that the removal of License Conditions 2.C(34) and 2.C(35), of the Columbia RFOL, is justified because License Condition 1.J remains unchanged.

The NRC staff pointed out that License Condition 2.C(35) contains a notification requirement that is still needed even after placing the commitments into the FSAR. This notification is not expected to be made for several years. The licensee replied that they would take this into consideration and may request to maintain the portion of License Condition 2.C(35) that requires notification to the NRC.

The licensee discussed two precedents, listing Vermont Yankee Nuclear Power Station and Cooper Nuclear Station, who have submitted similar LARs. The NRC staff stated that there are differences between Columbias situation and these precedents that might be relevant in its

review. The licensee also requested if the NRC review of the LAR could be done in a shorter period of time than the standard 1-year review.

No regulatory decisions or commitments were made at the meeting. No members of the public identified themselves on the teleconference. Public Meeting Feedback forms were not received.
