NRC INSPECTION REPORT 701257/97-07 AND NOTICE OF VIOLATION

Dear Mr. Femreite:

On December 1519,1997, the NRC conducted an inspection at the Siemens Power Corporation facility. An exit meetir$g was conducted with members of your staff at the conclusion of the onsite inspection. The inspection also included followup in-office revi3w and discussions with members of your staff on December 22 24,1997, to further review the stora0e of uranium powder in temporary storage facilities. The enclosed report presents the scope and results of this inspection.

The inspection included a review t,' selected activities at your facility ir. Richland, Washington.

The inspector noted that your staff hid implemented effective programs in emergency preparedness and selected areas of operations reviewed during the inspection. However, as discussed below one violation was identified involving the failure to comply with the temporary storage requirements of your license.

Based on the results of this inspection, the NRC has determined that a iolation of NRC requirements occurred. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding this violation are described in detail in the subject inspection report.

The violation is of concern because it involved a condition that existed for severai years and should have been recognized by your staff. We have received your letter dated December 29, 1997, acknowledging the violation and describing actions taken. Although this violation is licensee identified and could have been considered as a non-cited violation, we are issuing a citation because the reason for not recognizing and adhering to the license requirement has not been identified and corrected. You are t

• quired to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcerrent action is necessary to ensure compliance with regulatory requirements.
