Subject:

Violation of Temporary Storage Condition Based upon information provided by Sierrens Power Corporation (SPC) on December 18,1997 to C. A. Hooker of your staff while he was on site conducting inspection 97-07, SPC recognizes that it is in violation of its license condition on tempora.y storage of uranium oxide. This violation is by virtue of the fact that SPC is storing powder as well as pellets in temporary I_

storage facilities. After informing Mr. Hooker of this fact, OPC had subsequent telephone conversations with NRC Headquarters and Region IV personnel. Both concur with SPC's assessment of non-compliance.

The storage conditions that currently exist in temporary storage f acilities are safe because they all are in compliance with the requirements determined by the applicable crbuality safety analyses (CSAs). These CSAs provide the safety basis for such storage throughout SPC's plant. The current situation can be summarized as storage analyzed to be safe but occurring at locations not specifically authorized per the NRC license. Based on a conference call of December 23,1997, NRC-HQ Licensing Branch and Region IV inspection staff concur with this conc?usion, p

When the NRC grants SPC's request for license amendment to add the Operations Scrap Warehouse, SPC will move all non-compliant material to licensed storage locations. In the meantime, SPC will maintain the temporary storage containers in a locked condition except when removing material from these facilities or adding authorized material (pellets) to them.

Additionally SPC will not add any unauthorized material to the temporary storage locations. An amendment request to authorize the storage of a wider range of U bearing compounds in temporary storage facilities is expected to be submitted early next year.
