RETRACTION OF DISCHARGE REPORT PUBLIC SERVICE ELECTRIC AND GAS (PSE&G) SALEM GENERATING STATION (CASE #91-12-20-1524-55)
On December 20, 1991, PSE&G reported a discharge of approximately 20 to 30 gallons of an unknown liquid to the ground at the Salem Generating Station. The discharge was reported to the NJDEPE Hotline in accordance with NJAC 7:1E-5 and was assigned Case No. 91-12-20-1524-55 by Operator No. 21. Upon investigation, it was determined that the unknown liquid was sewage leaking from a broken sewer line. The discharge was contained in the immediate area of the broken line and did not reach a storm drain catch basin. The discharge was terminated and the area was disinfected with sodium hypochlorite.
PSE&G believes that it acted in accordance with the intent of NJAC 7:1E-5, which requires all major facilities to notify NJDEPE of discharges of petroleum and other potentially hazardous substances in any concentration.
However, upon review of the definition of hazardous substance in NJAC 7:1E-1.7, PSE&G has determined that sewage is not regulated.
Therefore, PSE&G was not obligated to notify the NJDEPE since the event did not constitute a discharge of a hazardous substance.
A followup phone call was placed at 1630 hours to the NJDEPE Hotline to retract the spill report. This letter serves as confirmation of that retraction.
