In Reference I, NextEra Energy Point Beach, LLC (NextEra) submitted a License Amendment Request (LAR) for Point Beach Nuclear Plant (PBNP) Units I and 2. The proposed amendment would increase each unit's licensed core power level to 1800 megawatts thermal and revise Technical Specifications (TS) to support this power level. In Reference 2, NextEra submitted two proposed Appendix C license conditions for modifications that will be installed prior to operation of either unit at extended power uprate (EPU) conditions.

In a teleconference on October 15, 201 0, the NRC requested that NextEra provide additional proposed license conditions that support the AFW portion of LAR 261. They address power sources for AFW pump systems and emergency diesel loading. Enclosure 1 provides new proposed license conditions that address the NRC's request. The marked-up Appendix C license condition pages also include the Appendix C license conditions submitted in Reference 2.

Document Control Desk Page 2 In Reference 3, NextEra provided revised proposed TS pages for the AFW system, along with a revised no significant hazards consideration (NSHC) evaluation. The NSHC evaluations provided in Reference 1 and Reference 3 are not altered by the additional license conditions.

The proposed changes continue to satisfy the criteria of 10 CFR 51.22 for categorical exclusion from the requirements for an environmental assessment.

This letter contains no new regulatory commitments.

The proposed license conditions have been reviewed by the Plant Operations Review Committee.

In accordance with 10 CFR 50.91, a copy of this letter is being provided to the designated Wisconsin Official.

APPENDIX C ADDITIONAL CONDITIONS OPERATING LICENSE DPR-24 NextEra Energy Point Beach, LLC shall comply with the following conditions and the schedules noted below:

228 At the time of the closing of the transfer of the licenses from Wisconsin Electric Immediately Power Company (WEPCO) to FPLE Point ~each', WEPCO shall transfer to FPLE Point ~each' WEPCO's decommissioning funds in an aggregate minimum value of $200.8 million for Point Beach Unit 1. FPLE Point ~each*

shall deposit such fungs in an external decommissioning trust fund established by FPLE Point Beach for Point Beach Units 1 and 2. The trust agreement shall be in a form acceptable to the NRC.

NextEra Energy Point Beach shall take no actions to cause FPL Group Immediately Capital, or its successors and assigns, to void, cancel, or modify its $70 million Support Agreement (Agreement) to NextEra Energy Point Beach, as presented in its application dated January 26, 2007, or cause it to fail to perform or impair its performance under the Agreement, without the prior written consent from the NRC. The Agreement may not be amended or modified without 30 days prior written notice to the Director of Nuclear Reactor Regulation or his designee. An executed copy of the Agreement shall be submitted to the NRC no later than 30 days after the completion of the license transfers. Also, NextEra Energy Point Beach shall inform the NRC in writing anytime it draws upon the $70 million Agreement.
