Dear Mr. Hale:

This e-mail is in reference to the NextEra Energy Point Beach, LLC (the licensee) submittal of a license amendment request (LAR)-261 dated April 7, 2009 (ADAMS Accession No. ML1091250564), to increase each units licensed thermal power level from 1540 megawatts thermal to 1800 megawatts thermal, and revise Technical Specifications to support operation at the increased thermal power level.

The U.S. Nuclear Regulatory Commission (NRC) staff in the Electrical Engineering Branch (EEEB) of the Office of Nuclear Reactor Regulation reviewed the information provided in LAR-264 dated January 27, 2010 (ADAMS Accession No. ML100280230), to revise Technical Specification 3.8.3, Diesel Fuel Oil and Starting Air. In LAR-264, the licensee proposes to revise the diesel fuel oil storage volume requirements for the emergency diesel generators. The NRC staff determined that additional information was required to continue its review. In an effort to complete the review, the staff has developed draft requests for additional information (RAIs).

A conference call was held on July 23, 2010, between the licensee and NRC staff to discuss the draft RAIs. During the phone call, Ms. Fritzie Flentje recommended that the proposed draft RAIs should be divided since one of the RAIs appeared directly applicable to LAR-264 and the other to LAR-261 associated with extended power uprate (EPU). Specifically, RAI-1 and RAI-2.e) should be associated with LAR-264 and the remainder of RAI-2 with LAR-261.

The NRC staff have agreed to split the RAIs, as requested, and the draft RAIs associated with LAR-261 are attached. The staff wants to emphasize that resolution of the licensing bases (7 days versus 48 hours5.555556e-4 days
0.0133 hours
7.936508e-5 weeks
1.8264e-5 months
) concerns is a priority since the EPU-related diesel fuel oil questions will be directly impacted by the outcome once the licensing basis is clarified and may potentially delay issuance of the EPU-related safety evaluation.

If required, the NRC staff can still discuss the draft RAIs with your staff in a conference call or meeting prior to formal issuance. Among other things, the discussion will include how the NRC would formally issue these questions and how the licensee will respond to them, including a proposed date for your formal response.

The sole purpose of this e-mail and its attachment is to prepare you and others for the proposed conference call or meeting. This e-mail and its attachment do not convey a formal NRC staff position, and do not formally request for additional information.

Please don't hesitate to contact me if you have any questions or concerns.

Sincerely,

Terry A. Beltz, Senior Project Manager Plant Licensing Branch III-1 Division of Operating Reactor Licensing Office of Nuclear Reactor Regulation (301) 415-3049 Terry.Beltz@nrc.gov E-mail Properties Mail Envelope Properties ()
