OF JULY 22,2010, MEETING WITH NEXTERA ENERGY POINT BEACH, LLC, TO DISCUSS OUTSTANDING ISSUES AND SCHEDULE RELATED TO NRC STAFF REVIEW OF LICENSE AMENDMENT REQUESTS ASSOCIATED WITH ALTERNATE SOURCE TERM, AUXILIARY FEEDWATER, EXTENDED POWER UPRATE, AND NON-CONSERVATIVE SETPOINT CHANGES (TAC NOS. ME0219, ME0220, ME1081, ME1082, ME1044, ME1045, ME1083 AND ME1084)

On July 22,2010, a Category 1 public meeting was held between staff from the U.S. Nuclear Regulatory Commission (NRC) and representatives of NextEra Energy Point Beach, LLC, at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss outstanding issues related to the Alternative Source Term (AST), Auxiliary Feedwater (AFW), Extended Power Uprate (EPU), and non-conservative setpoint change amendments currently under review by the NRC staff.

A list of attendees is attached as Enclosure 1. The licensee's presentation is provided as.

Discussion The licensee commenced its presentation by stating that the primary focus of the meeting was to solicit NRC staff feedback on issues associated with the subject amendment requests. The licensee emphasized that NRC approval of the AST, AFW, EPU, and non-conservative setpoint amendments was essential to support EPU implementation for Unit 2 coming out of the spring 2011 refueling outage.

The schedule was discussed near the close of the meeting. The NRC staff noted that the Point Beach EPU presentation before the Advisory Committee on Reactor Safeguards (ACRS) subcommittee is currently scheduled for mid-November and the ACRS full committee in early December. The Safety Evaluation Report for the EPU will need to be submitted to the ACRS at least 30 days prior to the subcommittee meeting. Additionally, it is likely that the ACRS will not address the EPU if the AST and AFW amendments have not already been approved, as these two amendments are integral to the power uprate. The NRC staff noted that the parallel review of these amendment requests has placed a considerable burden on personnel resources.

There have been numerous rounds of requests for additional information (RAls). The timeliness and quality of the responses must be satisfactory, as there cannot be any significant delays if the schedule is to be met.

- 2 The licensee next discussed the status of the Reactor Protection System/Engineered Safety Features Actuation System (RPS/ESFAS) reviews. The revised calculations to remove the single-sided uncertainty factor were completed and sample calculations were provided for NRC staff review. The licensee stated that all three planned submittals were to be issued by the end of July, including the revised RPS/ESFAS technical specifications and bases and non-EPU RPS/ESFAS.

The next portion of the meeting focused on the AST amendment. The Control Room Emergency Filtration System (CREFS) was discussed, including a comment from the NRC staff that it was continuing its review and may have additional questions for the licensee. The NRC staff noted that it may also have future questions related to the proposed Primary Auxiliary Building Ventilation System (VNPAB) technical specification. There was also a question from the NRC staff regarding the definition and pedigree related to the "augmented quality" safety classification of the VNPAB. The licensee stated that augmented quality is defined in the Quality Assurance Program, and then further clarified the basis for this classification as well as its comparison to a "safety-related" system or component. The NRC staff stated that further RAls may be requested related to CREFS, specifically pertaining to more information associated with emergency diesel generator loading values and how electrical isolation and separation will be maintained.

During discussion of the AFW amendment review, the licensee discussed the timetable for responding to the remaining RAls. The licensee stated that the NRC staff could anticipate responses to the remaining clarification requests by the end of July and first week of August.

The next topic of discussion was the status of the EPU amendment review. The licensee noted that it has issued all first-round RAI responses with the exception of the Electrical Engineering Branch. These RAI responses were tied to completion of calculations. The Balance of Plant Branch may have additional RAls following its review of the licensee's RAI responses expected by the first week in August. The NRC staff may also have additional questions from the Health Physics &Human Performance and Balance of Plant Branches. Finally, the Mechanical and Civil Engineering Branch will be providing additional RAls in early to mid-August.

The final discussion was the current status of the high-energy line break review. The licensee stated that they provided a response to the RAls associated with the 21-question Giarnbusso letter. The licensee will provide RAI responses to the Containment &Ventilation and Mechanical & Civil Engineering Branches in the first week of August. The licensee is awaiting potential follow-up RAls from the NRC staff.

There were no members of the public in attendance. Public Meeting Feedback forms were not received.
