Dear Ms. Sterdis:

By letter dated December 8, 2020 (Agencywide Documents Access and Management System [ADAMS]) Accession No. ML20345A249 and ML20345A260 (non-public, withheld under Title 10 of the Code of Federal Regulations [10 CFR] Part 2.390), Holtec Decommissioning International, LLC (HDI) submitted a request for amendment to the renewed operating license (ROL) for Oyster Creek Nuclear Generating Station (OCNGS).

Specifically, HDI is requesting approval of the proposed revision to the OCNGS Independent Spent Fuel Storage Installation (ISFSI) Security Plan, Training and Qualification Plan and Safeguards Contingency Plan (the Plan) and the removal of the reference to 10 CFR 73.55 requirements from the ROL. The revised Plan, if approved, would address the protection of material on site such as at the ISFSI and other special nuclear material on site, with the exception of material subject to the requirements of 10 CFR 37, Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material.

The proposed revision of the Plan applies to the ISFSI Only status where all the remaining spent fuel in the spent fuel pool at the time of permanent cessation of reactor operations has been transferred to the ISFSI with no future spent fuel transfer to the spent fuel pool.

Currently, HDI plans to complete its spent fuel transfer campaign by November 2021. HDI requested the U.S. Nuclear Regulatory Commission (NRC) approval of this proposed license amendment application by July 2021.

The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your request and the supplemental response submitted by HDI on January 29, 2021 (ADAMS Accession No. ML21036A169 and ML21036A170, non-public, withheld under 10 CFR 2.390) and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised through separate correspondence by April 30, 2021, and a response will be due 30 days from the receipt of the request for additional information.

The NRC staff expects to complete this review by September 30, 2021 (approximately 650 hours0.00752 days <br />0.181 hours <br />0.00107 weeks <br />2.47325e-4 months <br />). If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date, the reasons for the changes, along with a new estimate, will be communicated during the routine interactions with the assigned project manager. The associated notice of consideration of issuance of amendment to facility operating license, proposed no significant hazards consideration determination, and opportunity for a hearing is scheduled to be published in NRCs biweekly Notice in the Federal Register on March 23, 2021.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this email will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS.
