To aid with next week's call, I'm providing initial answers to the two questions highlighted by Holtec in their earlier email to NRC. I am happy to discuss these in more detail next week.

1. With the elimination of an ITS, we need to understand what our obligations are moving forward.

How do we deal with turtles that are injured or dead due to non-OCNGS impacts?

Because we have determined that incidental take is not reasonably certain to occur, we would not provide an Incidental Take Statement. In the event that a dead, sick, or injured sea turtle was observed, the appropriate Sea Turtle Stranding Network partner should be notified and would provide any instructions for collection and handling or disposal. In New Jersey, that partner is the Marine Mammal Stranding Center. This would be treated just as a report from a member of the public would be. 1. In section 12, we would like additional clarification regarding what the requirements are/what responsibilities the site will have.

Section 12 is the Conservation Recommendations. Conservation Recommendations are NMFS non-binding suggestions that: (1) identify discretionary measures a Federal agency can take to minimize or avoid the adverse effects of a proposed action on listed or proposed species, or designated or proposed critical habitat; (2) identify studies, monitoring, or research to develop new information on listed or proposed species, or designated or proposed critical habitat; and (3) include suggestions on how an action agency can assist species conservation as part of their action and in furtherance of their authorities under section 7(a)(1) of the ESA. There are recommendations that we make that NRC can pursue to enhance the conservation of ESA listed species. There are no obligations, requirements, or responsibilities for NRC or Holtec related to the conservation recommendations.
