Dear Ms. Sterdis:

By letter dated March 16, 2021 (Agencywide Documents Access and Management System

[ADAMS]) Accession No. Main Library [ML] ML21075A337), Holtec Decommissioning International, LLC (HDI) submitted a license amendment request, for approval of the proposed amendment to the Renewed Facility Operating License DPR-16 for Oyster Creek Nuclear Generating Station (OCNGS). The proposed amendment would revise the Title 10 of the Code of Federal Regulations (10 CFR) Part 50 License and associated Technical Specifications (TS) to reflect removal of all spent nuclear fuel from the spent fuel pool (SFP) and its transfer to dry cask storage within a site controlled Independent Spent Fuel Storage Installation (ISFSI).

By letter dated March 31, 2020 (ADAMS Accession No. ML20091M858), HDI provided an updated decommissioning schedule indicating that off-load of the OCNGS spent fuel pool and transfer of the spent fuel to the ISFSI is expected to be completed by November 3, 2021. Most recently, HDI indicates it now anticipates completion of OCNGS spent fuel transfer in June 2021 as opposed to November 2021. In support of this condition, a revision to the OCNGS facility license and associated TS is proposed to comport with the requirements for a facility configuration with all spent nuclear fuel in dry storage within an ISFSI. In its application, HDI requests approval of the ISFSI Only TS by August 1, 2021.

The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your request and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised through separate correspondence by the end of April 2021, and a response will be due 30 days from the receipt of the request for additional information.

The NRC staff expects to complete this review by August 1, 2021 (approximately 200 hours0.00231 days <br />0.0556 hours <br />3.306878e-4 weeks <br />7.61e-5 months <br />). If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date, the reasons for the changes, along with a new estimate, will be communicated during the routine interactions with the assigned project manager. The associated notice of consideration of issuance of amendment to

facility operating license, proposed no significant hazards consideration determination, and opportunity for a hearing is scheduled to be published in NRCs biweekly Notice in the Federal Register on April 20, 2021.
