[External_Sender] RE: State Consultation: Oyster Creek Nuclear Generating Station - ISFSI-only Physical Security Plan Date: Monday, June 7, 2021 10:22:05 AM Attachments: image001.png Good Morning Zahira, On December 8th and supplemented by letter dated January 29, 2021, Holtec Decommissioning International (HDI) submitted License Amendment Request (LAR) to amend the Independent Spent Fuel Storage Installation Physical Security Plan for the Oyster Creek Nuclear Generating Station.

The proposed amendment would revise the Security Plan, Training and Qualification Plan, and Safeguards Contingency Plan and remove the reference to 10CFR 73.55 requirements from the Oyster Creek Nuclear Generating Station (OCNGS) operating license. The security requirements of 10 CFR Part 73, as applicable to a licensed facility, presume that the purpose of the facility is to possess and utilize Special Nuclear Material (SNM). Oyster Creek has moved all spent fuel assemblies to the dry cask storage system and placed them onsite on their independent spent fuel storage installation (ISFSI). There is significant reduction in potential radiological accidents and security concerns since all spent fuel has been permanently moved to ISFSI pad. Since the Oyster Creek plant is not an operating plant and the security concerns are drastically reduced, the security plan can be revised accordingly to remove reference to 10 CFR73.55. The proposed amendment is consistent with similar NRC approved amendments issued for other decommissioning power plants. Therefore, the New Jersey Bureau of Nuclear Engineering has no comments.

[EXTERNAL] State Consultation: Oyster Creek Nuclear Generating Station - ISFSI-only Physical Security Plan Good Afternoon, We are near completion of an amendment application review to amend the Independent Spent Fuel Storage Installation Physical Security Plan for the Oyster Creek Nuclear Generating Station. The amendment will be issued in response to Holtecs application dated December 8, 2020, as supplemented by letter dated January 29, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML20345A249 and ML21036A169, respectively). The enclosures to these letters may not be publicly available in ADAMS as they contain security-related and safeguards information. The proposed no significant hazards consideration determination was noticed in the Federal Register on April 6, 2021. I am providing a copy of the Federal Register Notice (FRN),

attached, per 10 CFR 50.91 (b)(2).

The proposed no significant hazard determination is addressed by the licensee its application (ADAMS Accession No. ML20345A249), Attachment 1, Section 5.2, and the NRCs proposed no significant determination is addressed in the FRN (attached). We are considering finalizing this determination. Also, we believe a Categorical Exclusion would apply.
