Subject:

State Consultation - Oyster Creek Nuclear Generating Station: ISFSI-only Emergency Plan Good Afternoon, We are near completion of an amendment application review to amend the Independent Spent Fuel Storage Installation Emergency Plan for the Oyster Creek Nuclear Generating Station. The amendment will be issued in response to Holtecs application dated February 23, 2021 (ADAMS Accession No. ML21054A321), as supplemented by letter dated April 30, 2021 (ADAMS Accession No. ML21120A110). The proposed no significant hazards consideration determination was noticed in the Federal Register on March 23, 2021. Here is a link to the Federal Register Notice (FRN): https://www.govinfo.gov/content/pkg/FR-2021-03-23/pdf/2021-05248.pdf per 10 CFR 50.91(b)(2).

The proposed no significant hazard determination is addressed by the licensee its application (ADAMS Accession No. ML21054A321), Enclosure 1, Section 6.3, and the NRCs proposed no significant determination is addressed in the FRN. We are considering finalizing this determination. Also, we believe a Categorical Exclusion would apply.

If the State of New Jersey has comments on this license amendment request, please e-mail me and Zahira Cruz-Perez (in Cc) your comments or provide an email if you have no comments by the close of business by June 14, 2021.
