Dear Ms. Sterdis:

By letter dated February 23, 2021 (Agencywide Documents Access and Management System [ADAMS]) Accession No. Main Library [ML] ML21054A321), Holtec Decommissioning International, LLC (HDI) submitted a license amendment request for review and approval of the Oyster Creek Nuclear Generating Station (OCNGS)

Independent Spent Fuel Storage Installation Facility (ISFSI) Only Emergency Plan and its associated Emergency Action Level scheme. The proposed changes are being submitted to the U.S. Nuclear Regulatory Commission (NRC) for approval prior to implementation, as required under Paragraph 50.54(q)(4) of Title 10 of the Code of Federal Regulations (10 CFR).

HDI expects to complete off-load of the OCNGS spent fuel pool and transfer of the spent fuel to the ISFSI by Summer 2021. In support of this condition, revisions to the OCNGS Emergency Plan and associated Emergency Action Level Scheme are proposed to comport with the requirements for a facility configuration with all spent nuclear fuel in dry storage within the ISFSI.

The NRC staff has reviewed HDI's submittal and determined that additional information is required to enable the NRC staff to make an independent assessment regarding its technical review.

The enclosure to this email provides the request for additional information (RAI). On April 5, 2021, the draft RAI questions were sent to you to ensure that they were understandable, the regulatory bases for the questions were clear, and to determine if the information was previously docketed. Teleconference was held on April 8, 2021 with James Frank and Dave Noyes of your staff to clarify the RAI questions. HDI stated they would respond to the RAI within 30 days of the date of this email.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this email and enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS.
