APPENDIX A Notice of Violation Boston Edison Company Docket No. 50-293 Pilgrim Nuclear Power Station License No. DPR-63 Plymouth, Massachusetts As a result of the inspection conducted at the Pilgrim Nuclear Power Station from February 6 through March 10, 1989, and in accordance with the NRC Enforce-ment Policy (10 CFR 2, Appendix C), the following violation was identified:

10 CFR 71.5(a) states in part that "Each licensee who... delivers licens-able material to a carrier for transport shall comply with the applicable requirements of the regulations appropriate to the mode of transport of DOT in d9 CFR Parts 170 through 189." 49 CFR 172.203(d)(1) states in part that "The description for a shipment of radioactive material must include the following additional entries as appropriate: (1) The name of each radionuclides in the radioactive"material...(iii) The activity contained in each package of the shipment. .. 49 CFR 172.204(a) states in part that

".. .each person who of fers a hazardous material for transportation shall certify that the material is offered for transportation in accordance with this' subchapter... "

Contrary to the above, the licensee made severteen shipments of contam-inated laundry between January 1988 and February 1989 which failed to identify the presence of Iron-55 and the activity resulting from the radionuclides on the shipping papers. Consequently, the shipper's certifi-cation was also in error.

This is a Severity Level IV violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, Boston Edison Company is hereby required to submit to this office within thirty days of the date 'of receipt of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
